By providing your phone number(s) and confirming your acceptance of SMS/text message from or on behalf of Fox Factory, Inc. or its subsidiaries (collectively “Fox”), including text messages made with an automatic telephone dialing system, you agree to be bound by these Fox Text Messaging Terms & Conditions (“Terms”), Fox’s Terms of Use, Fox's Privacy Policy, and any other applicable terms related to your use of Fox’s services. You may opt‑out of these communications at any time. Your consent to receive marketing text messages is not required and is not a condition to purchase any goods or services.

 

Your Mobile Phone Number

You affirm that you are the rightful owner for any phone number(s) that you provide. Should you change your phone number you are responsible for notifying Fox immediately. You may notify Fox of a number change via the “Contact Us” page on our website.

You agree to indemnify Fox in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify Fox if you change your telephone number, including but not limited to all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act and state telemarketing laws.

Program Overview

Fox or its service providers may send SMS or MMS messages to your number via automated technology. Texts may relate to several programs, including:

 

• Marketing and Promotions: Recurring messages about sales, discounts, loyalty programs, and special offers.
• Service Appointments: Reminders and updates about your appointments or services.
• Order Tracking: Alerts about your orders, shipments, and deliveries.
• Back-in-Stock Notifications: Updates when products are available again.

 

Opting In

To opt into a program, follow the instructions for that specific program, either through our website  or by texting a keyword to the designated short code. Upon opting in, you will receive two confirmation texts—one asking for your opt-in confirmation and a second after you reply “Y.”

Opting Out

If you wish to discontinue any program or revoke your consent to these terms, text STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to the short code for the program. You may receive a final message confirming your opt-out. Be aware that any other opt-out messages not containing these exact terms may not be recognized, and Fox will not be liable for unprocessed requests. If you are subscribed to multiple programs, you must opt out of each one individually.

Message Frequency

Message frequency will vary depending on which program(s) you sign up for. You may receive text messages, including but not limited to:

• Program enrollment
• Placed orders or scheduled services
• Shipped or delivered items
• General promotions
• Back-in-stock alerts
• Cart reminders

 

Fox reserves the right to adjust message frequency and may change the number or short code from which messages are sent. In case of such changes, Fox will notify you when we do so.

Costs

Message and data rates may apply. Please check with your mobile carrier for details about your pricing plan and the charges for sending and receiving text messages. You are solely responsible for any costs related to or associated with your receipt of text messages.

Supported Carriers

Not all carriers, mobile devices, or handsets may be supported and our messages may not be deliverable in all areas. Fox, its service providers and the mobile carriers supported by the program are not responsible for delayed or undelivered messages.

Network Access is Not Guaranteed

The availability of these text messaging programs are offered on an "as-is" basis and may not be available in all areas at all times and may not continue to work in the event of product, software, coverage or other changes made by your wireless carrier. Fox will not be liable for any delays or failures in the receipt of any mobile messages connected with any text messaging program.

 

Device & Service Requirements

To participate, you need a mobile device capable of two-way messaging, a text messaging plan, and a compatible carrier. Check with your carrier for specific instructions and support. Check your phone capabilities for specific text messaging instructions.

Governing Law

This Agreement shall be governed by the laws of the State of Georgia, without reference to conflict of laws principles. Any suit to enforce this Agreement, shall be brought exclusively in the State and U.S. District Courts located in Duluth, Georgia and the Parties hereby submit to the personal jurisdiction of such courts and waive any venue objection.

Miscellaneous

You warrant and represent to us that you have all necessary rights, power, and authority to agree to these Terms and perform your obligations hereunder, and nothing contained in these Terms or in the performance of such obligations will place you in breach of any other contract or obligation. The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable. Any new features, changes, updates or improvements of any program shall be subject to these Terms unless explicitly stated otherwise in writing.

Fox reserves the right to change these Terms from time to time without notice, and in its sole discretion. If Fox decides to change these Text Messaging Terms & Conditions, Fox will post a new version on the Sites and update the date set forth above.

Any changes or modifications to these Text Messaging Terms & Conditions, guidelines or rules will be effective upon posting of the revisions. The updated text messaging terms & conditions will replace the prior version and are applicable to any future disputes between the parties, regardless of when the disputed interactions arose.
