Ridefox.com offers certain products for purchase before they are available for immediate shipment, including items that are temporarily out of stock and expected to be restocked, as well as items that have not yet been released. These transactions are referred to collectively as Backorders and Pre‑orders. A “Backorder” involves the purchase of a product that is currently unavailable but anticipated to return to inventory, while a “Pre‑order” involves the purchase of a product that has an upcoming release or availability date. By placing a Backorder or Pre-order, the Customer acknowledges that the item will not ship at the time of purchase and agrees to the these Terms and Conditions, which govern all such transactions on ridefox.com.

1.    Availability of Backordered and Pre‑Order Items

Certain products offered on ridefox.com may be designated as Backordered or available for Pre-order. Availability dates, estimated shipping dates, and release dates are provided based on information received from suppliers and may be subject to change. FOX does not guarantee that estimated dates are final.

FOX reserves the right to limit quantities and close Pre-order or Backorder availability at any time or discontinue items without prior notice.

If a Backordered or Pre-order item becomes unavailable, or if additional units become available after release, Customers may sign up for email notifications on the product page. Signing up for notifications does not guarantee availability or price.

2.    Methods of Payment

Backordered and Pre-ordered items are charged at the time the order is placed. A preauthorization may be placed at checkout to verify the Customer’s payment method. The temporary preauthorization hold may appear on the Customer’s account and will clear in accordance with the Customer’s financial institution’s policies. If a preauthorization expires before fulfillment, FOX may place a new authorization closer to the confirmed availability date. Backorders and Pre-orders may be purchased only with debit cards, credit cards, or FOX gift cards unless otherwise stated.

3.    Shipping and Fulfillment

Backordered items will ship promptly once inventory is restocked. Pre-ordered items will ship once they become available. If an order contains multiple items with different availability dates, FOX may ship the items separately. If items share the same availability date, they may ship together. The Customer will receive a shipping confirmation email for each shipment. All shipping timelines are estimates and may be affected by supplier delays, manufacturing issues, or other circumstances outside FOX’s control.

4.    Customer Cancellation Rights

Customers may cancel a Backorder or Pre-order prior to the estimated shipping date for a full refund. Customers may request cancellation by contacting FOX Support at bikesales@ridefox.com.

If the estimated shipping date is delayed by more than 60 calendar days beyond the original estimate, FOX will automatically cancel the order and issue a refund unless the Customer expressly consents to the revised date.

After shipment or once processing has begun, cancellation is no longer possible. However, the Customer may request a return in accordance with FOX’s standard return policy.

5.    FOX‑Initiated Cancellations

FOX may cancel a Backorder or Pre-order if the manufacturer reduces available quantities, if the product is discontinued, if pricing or listing errors occur, if fraud‑prevention measures require cancellation, or if FOX is unable to fulfill the order within a reasonable time. FOX will notify the Customer of any cancellation and will issue a full refund to the original payment method.

If FOX cancels an order, the Customer will receive written notice and a full refund to the original payment method.

6.    Delay Notifications

If FOX cannot ship a Backorder or Pre-order by the original estimated shipping date, FOX will notify the Customer of the delay, provide a revised estimated shipping date, and offer the Customer the option to cancel the order for a full refund.

If the Customer does not respond within the timeframe stated in the notice, FOX will proceed in accordance with applicable law, which may include automatic cancellation and refund.

7.    Refunds

Refunds for canceled Backorders or Pre-orders will be issued to the original payment method. Refund timing may vary depending on the Customer’s financial institution but will comply with applicable legal requirements.

8.    Non‑Transferability

Backorders and Pre-orders are non‑transferable. Orders will ship only to the individual and address provided at checkout. FOX may refuse shipment or cancel an order if it appears that the order has been transferred, resold, or altered in a manner inconsistent with these terms herein.

9.    No Guarantee of Release

For Pre-order items, FOX does not guarantee that a product will release on the estimated date or at all. In the event a product is canceled by the manufacturer or becomes permanently unavailable, FOX will cancel the order and issue a full refund.

10.  Customer Responsibilities

Customers are responsible for ensuring that payment information is accurate, that shipping addresses are correct, and that emails from FOX, including delay notices, are not blocked or filtered. Failure to maintain accurate information may result in delays or cancellation.

11.  Governing Terms

These Terms and Conditions form part of the overall Ridefox.com Terms & Conditions and apply in addition to all other site policies, including the Privacy Policy and Return Policy. In the event of a conflict, these Terms and Conditions govern all Backorder and Pre-order transactions.
